Collector’s Consignment Opportunity

Through the expertise of Dave Bushing and Troy Kinunen and their extensive hobby knowledge, collectors can now consign their items for sale via the most well-respected website in the industry. We know you have many choices when it comes to buying and selling your memorabilia and game-used items, so why should you choose to consign your items through Dave Bushing and Troy Kinunen over other venues? The consignment fee is only 15%. We do NOT charge a buyers fee so the additional money the buyer is willing to pay goes in YOUR pocket, not ours. At auction, a $2,500 item would cost the buyer $3,000 and the auction house would get $500 of that in addition to the 15% they take from you! So you would end up with only $2,125. If you sell that same item through Dave Bushing and Troy Kinunen, you can ask $3,000 (and remember that you set the price), and since the buyer will not be paying the standard 20% buyer’s fee that auction houses charge), you will receive $2,550. It’s a win-win situation! The buyer pays less and you get more!

In addition, your item will be sold with a MEARS Letter of Opinion and you receive all the security that accompanies that. If we make an error and an adjustment needs to be made with the buyer, we handle that, not you! How many auction houses stand behind their consignors in that way?

Here is how it works:

  1. Contact Dave Bushing or Troy Kinunen to tell them what you have and what return you desire. As experts in the field, Dave and Troy will advise you throughout the process to make certain that your item is handled in the most professional manner in order to achieve the best possible results. We will be working with you and for you - our goals are the same - to get you top dollar!

  2. The item will be authenticated at the retail evaluation rate. Since YOU set the price, please factor this in as you determine your asking price, while keeping it reasonable enough to attract a buyer. Remember no one benefits if your item doesn’t sell.

  3. The item will run on the site for 30 days and will be marked as “Consignment.” This enables you to have the option, in the event it is not selling, to extend the time and/or adjust your asking price.

This agreement, dated _______________, 2007, between Dave Bushing, herein referred to as "Seller" (seller is defined as Dave Bushing offering the item (s) for sale on behalf of the consignor), and the undersigned “Consignor” (consignor is defined as the person owning the item(s) being offered for sale) ______________________________________ agree to offer the following item (s) for sale on “Sellers” website, hosted at www.mearsonline.com:

“Consignor” has set the price of sale of item (s) at $_______________________.

Please note that the price is determined solely by the Consignor. The Seller makes no claim to the future value of listed item and the Seller has the right to refuse any and all consignments of item (s) with unrealistic asking prices or priced beyond the current market value. Dave Bushing may advise on current market value as determined by recent private sales, auction results and ebay sales.

By consigning said item(s) to the Seller for sale, the consignor also agrees:

  1. You “Consignor” warrant to Dave Bushing, MEARS and the Buyer that you are the sole owner of said item (s) and you have the right to consign it for sale, that there are no liens on it, that clear title and right to possession will pass from you to the Buyer free from all liens, claims, and that you have provided us with any information you possess regarding the item (s) provenance and that the descriptions provided are true and accurate. The Consignor will, in no instance, offer any item that was originally purchased as “game issued” to Dave Bushing and represent it as game worn. In cases of fraudulent misrepresentation, Dave Bushing will automatically notify the appropriate law officials and provide a signed copy of this consignment agreement along with all contact information to law enforcement.
  2. The Consignee shall provide all available information with each item and which will be given to the purchaser of that item. This may include original provenance, invoice, history, and all existing letters of authenticity. In no instances shall a consignee withhold a contrary or negative letter of opinion from the Seller or final customer. All information associated with the item shall be made available to any interested parties.
  3. Consignor is responsible for all the costs associated with shipping the item(s) to the Seller, including packing and shipping charges, insurance costs, other handling expenses, and risk of loss or damage incurred in both the delivery of item(s) from the Consignor to the Seller, and in the return of item (s) from Seller to Consignor as applicable.
  4. Consignor agrees to leave the item (s) with the Seller for a minimum of 30 days. Should the merchandise remain unsold at the end of the consignment period (30 days) and the consignor elects to remove said item (s) from sale, any costs incurred for the return delivery of the item(s) to the Consignor shall be borne by Consignor.
  5. In addition, should the item (s) remain unsold after the consignment period, the Seller and Consignor may extend the consignment period of this agreement for the same item (s) or shall execute a new consignment agreement if new item (s) wishes to be offered, upon approval of the Seller. After 30 days, Seller may lower the asking price upon the approval of the Consignor.

  6. Consignor commits to leaving the item (s) with the Seller for the full length of the consignment period (30 days). In the event that the consignor requests the return of the item (s) before the close of the consignment period, 15% of the asking price will be paid to Seller prior to return of the item (s) to the Consignor.
  7. Consignor agrees to retain MEARS to evaluate and grade each consigned item prior to offering in order to insure the accuracy of the description and authenticity. No item (s) will be listed until this evaluation has been completed. The full retail cost of the item(s) will be charged to Consignor (please see www.mearsonline.com/services/fees for fee schedule). If item (s) fails to sell, all authentication fees must be paid prior to item(s) return to Consignor. If after 180 days the Consignor fails to pay the authentication fees, the consignor agrees to allow the item(s) to be sold via auction for the current market value. All costs associated with the sale of the item (s) will be deducted from the proceeds along with a 15% handling fee to the Seller and the authentication fees. The remainder of the auction proceeds will be paid to consignee within 30 days of receipt of payment from the auction house.
  8. Seller will make every attempt to obtain the agreed upon price and will accept no less that the stated amount as determined by individual unless authorization is received from the Consignor in writing.
  9. In the event of a successful sale, the Seller will receive 15% of the purchase (asking) price. There will be no buyer’s premium added to the purchase price, only tax where applicable and the 15% commission will be deducted from the sale proceeds. The Consignor will receive payment for a sold item, less the 15% commission, within 30 days of receipt of payment from the purchaser.
  10. All items offered for sale by Seller under this consignment agreement will be clearly marked as such on the website.
  11. The Seller represents that insurance coverage for the item (s) against theft or damage will be maintained at all time while said item (s) are in the possession of the Seller. Insurance coverage will be at the asking price.
  12. The Seller represents that item(s) will not be removed from the premises for purposes of rental, installment sales or on approval sales without express permission from the Consignor.
  13. The Seller reserves the right to reject or return any item (s) deemed inappropriate or offered at a level egregiously higher than current market value as determined by Seller.
  14. The Seller shall collect Wisconsin sales tax, when applicable, upon sale of item(s), and be responsible for remitting all sales taxes collected to the Wisconsin Department of Revenue.
  15. Consignor authorizes the Seller to rescind the sale of an item (s) if Seller discovers the item (s) was inaccurately represented to us or if it is found to be a forgery or counterfeit. If Seller notifies you of such a rescission, Consignor agrees to return all proceeds paid to Consignor in connection with the sale of said item (s) and said item (s) will be returned to Consignor.
  16. Neither the Seller nor the Consignor may amend this agreement, unless both parties agree, in writing, to do so. This Agreement shall be deemed to have been made in the State of Wisconsin, and shall be governed by the laws of the State of Wisconsin, exclusive of its rules governing choice of law and conflict of laws.
  17. Consignor agrees to indemnify and hold the Seller, MEARS and their subsidiaries, affiliates, officers, directors, agents, and employees, harmless from any claim or demand, including attorneys' fees, relating to the breach of this consignor agreement or warranties made in this agreement. The warranties and indemnity will survive the completion of the transactions described in this agreement. This Agreement is personal to the Consignor, and the Consignor may not assign rights or obligations to anyone.
